Agreements of Sale

Placing an item in a shopping basket or adding it to a wish list without completing the purchase cycle does not:

Constitute an agreement of sale with Verlaque Foods and users cannot hold Verlaque Foods liable if such items are not available when the purchase process is completed later; and/or
Constitute an order for such an item; and
Verlaque Foods may remove such an item from the shopping basket or wish list if no stock is available.

An agreement of sale between Verlaque Foods and a user only comes into effect if and when:

a credit card authorisation is received from the issuing bank; or 
a deposit of an electronic transfer is reflected on Verlaque Foods bank statement (and only if such payment is received within 5 (five) business days after completion of the purchase process); or
a direct deposit is reflected on Verlaque Foods bank statement (and only if such payment is received within 5 (five) business days after completion of the purchase process.

Verlaque Foods reserves the right to refuse to accept and/or execute an order without supplying any reasons. Verlaque Foods also reserves the right to terminate orders in whole or in part as circumstances dictate. Verlaque Foods shall only be liable to refund monies already paid by the user.

Verlaque Foods shall make all reasonable efforts to maintain correct prices. However, should errors occur and items are offered at incorrect prices or costs, Verlaque Foods will not be obliged to sell goods at such incorrect prices and shall only be liable to refund monies already paid. 

Availability of Stock

Stocks of all goods on offer are limited. Verlaque Foods shall take all reasonable efforts and actions to discontinue the offer as soon as stock is no longer available. However, should items still be offered after stocks are sold, Verlaque Foods should only be liable to refund monies where it is unable to fulfill orders at displayed prices.

Payment Options

All transactions will be processed in South African Rands (ZAR).

Credit card payments

At the time of placing the order, the transaction details are presented to the bank and an authorization is obtained for the amount of the order.

Payment is only collected when the order is completed.

Note that to protect it's own and the interests of its customers, Verlaque Foods evaluates all transactions carefully to prevent attempted fraud and a transaction may be refused if Verlaque Foods is not satisfied or questions the legitimacy of the transaction.

Bank deposit payments

If the buyer selects the ‘bank deposit' button, instructions will be given on how to deposit monies into the Verlaque Foods bank account and would be subjected to the following rules:

The exact amount must be paid.
The payment must be identified by supplying the order number and surname in the reference section of the deposit slip or on the electronic transfer.
No transfers must be made from ATM's
Cheque deposits are subject to a clearing period - usually 10 working days.
No bank deposits are accepted from outside the borders of South Africa.
Unpaid bank deposit orders are cancelled after five working days.

Virtual Card Services process all our credit card transactions. All credit card transactions are 128 bit Secure Socket Layers (SSL) encrypted. Virtual Card Services is committed to providing secure online services. All encryption complies with international standards. Encryption is used to protect the transmission of personal information when completing online transactions. Virtual Card Services Internet servers are protected by firewalls and intrusion detection systems.

The Merchant does not have access to credit card details.

Virtual Card Services continually reviews and enhances its security in line with technological changes.

Any person that delivers or attempts to deliver any damaging code to this web site or attempts to gain unauthorised access to any page on this web site shall be prosecuted and civil damages shall be claimed in the event that Verlaque Foods suffers any damage or loss.

The user agrees and warrants that its log-in name and password shall:

be for personal use only; and
not be disclosed to any third party.

The user allows Verlaque Foods to take all reasonable steps to ensure the integrity and security of the Verlaque Foods site and back-office applications.

Monitoring

The Conditions will be exclusively governed by and construed in accordance with the laws of South Africa whose Courts will have exclusive jurisdiction in any dispute, save that we have the right, at our sole discretion, to commence and pursue proceedings in alternative jurisdictions.

Verlaque Foods may electronically collect, store and use the following personal information of Users:

country of residence;
closest city;
e-mail address;
IP address;
ID number / passport number.

Verlaque Foods collects, stores and uses the above information for the following purposes:

to welcome and greet the User when he/she enters the Verlaque Foods web site;
subject to the User's consent, inform the User of facts relating to his/her access and use of the Verlaque Foods website;
subject to the User's consent, inform the User about competitions and special offers from Verlaque Foods and/or its partners/affiliates;
